Employers Are Prohibited From Discriminating But Some Still Do

For years, Mr. Freedman has also advocated on behalf on many individuals who are part of the LGBTQ community facing discrimination in the workplace. In October 2019, the Supreme Court issued a landmark decision in Bostock v. Clayton County, holding that Title VII of the Civil Rights Act forbids discrimination against individuals who are gay or transgender. Employers cannot discrimination against individuals for being homosexual or transgender. It is a violation of federal law, as well as state law in Maryland and Virginia. The Commonwealth of Virginia recently expanded protections in the workplace for the LGBTQ community through the Virginia Values Act. The law banned discrimination on the bases of sexual orientation and gender identity, and also created greater enforcement mechanisms for employees.
